Man Arrested After Teen Lies About Her Age

LUBBOCK, TX — A 25-year-old was arrested and charged with sexual assault of a child after a 15-year-old girl allegedly lied about her age.

According to court documents, Lubbock Police were called to the 2500 block of 37th Street for a welfare check on June 9. Dispatch notes stated a 15-year-old girl reported feeling faint after taking medication provided by a friend.

While being treated in an ambulance, the girl told EMS and her mother, who had been called to the scene, that she had engaged in sexual activity the night before with a man, later identified as Israel Davila, 25.

Court documents state that the teen told police she lied about her age and claimed to be 19 when she first met Davila. She said she snuck out of her parents’ apartment and was provided an Uber to Davila’s house at around 2:00 a.m., where the two had sex.

She stayed at his house after Davila left for work at 9:00 a.m. the following morning and took the medication. The victim then called 911 for help.

Police later spoke with a roommate who arrived at the house and confirmed Davila had a girl over the night prior. The roommate also confirmed that he left the house around 9 a.m. to go to work.

Officers arrived at Davila’s place of employment and asked management for a man named Israel. The management on duty brought the only “Israel” currently working the shift into an office with two officers.

According to court documents, Davila understood the reason for the interview because his roommate had informed him of the situation at the house earlier. Davila began to confess on his own without any questioning from the officers. After officers stopped him and read his Miranda Warning, he waived his right to an attorney and continued to speak with officers.

Davila reportedly told police he first met the girl at his workplace, where she was with her parents and appeared to be drinking alcohol with them. Believing she was of legal age, he told the officers she gave him her phone number and told him she was 22.

Court documents state the two stayed in contact for about two weeks before she took an Uber to his home that night, and told police he did have sexual intercourse with the girl at around 3 a.m. at his house.

He was told the victim’s real age during the interview and stated that he was completely unaware that she was 15 years old.

Davila was informed of the severity of the situation and placed under arrest.

Israel Davila was transported to the Lubbock County Detention Center and booked for Sexual Assault of a Child.

His total bond remains at $15,000.
