Man Arrested After Subway Employees Held at Gunpoint in Robbery

LUBBOCK, TX — A Lubbock man is behind bars after police say he robbed a Subway restaurant at gunpoint on Wednesday.

According to court documents, Lubbock Police officers responded to a Subway located at 2515 82nd Street on April 23 after a report of an armed robbery. Dispatch advised that the suspect was a Hispanic male dressed in all black and wearing a facemask who was reportedly armed with a handgun.

When officers arrived to the restaurant, an employee told them the suspect, later identified as Zayven Constancio, 24, entered the sandwich shop wearing a black zip-up hoodie with the hood pulled over his head, black pants, a black ski mask layered with a blue medical mask, blue gloves, and was carrying a plastic bag.

According to the employee, Constancio asked for a sandwich before pulling a handgun and pointing it at him, saying, “Give me all the money.” Constancio reportedly also said, “I don’t want to hurt you.”

The employee went to the back area of the restaurant and notified a second worker that they were being robbed. Constancio followed the employee to the back and said, “Give me all the money,” while still pointing the gun at them. After the employees opened the register and handed over the cash, Constancio then fled the store.

While officers were speaking with the Subway staff, another officer patrolling the area spotted a man walking near the 8400 block of Flint Avenue. He was wearing a black T-shirt, blue jeans, black shoes, and a black backpack, matching the description given by Subway employees.

The officer stopped the man and identified him as Zayven Constancio. He then searched his body and found a firearm tucked into his waistband without a holster. A search in his backpack found clothes in line with the suspect's clothes from the robbery: a black hoodie, black pants, and a set of medical masks.

Court documents state that Constancio could not provide the officer with a reasonable explanation as to why he was in the area.

Based on the matching description of the handgun on his person and the clothes in his backpack, officers believed Constancio was the suspect who robbed the Subway. Officers arrested Zayven Constancio for Aggravated Robbery.

After being placed in handcuffs, a search of his pockets turned up a large amount of cash in his front pocket, believed to be the money taken from Subway.

Constancio was booked into the Lubbock County Detention Center, where he remains held on a $75,000 bond.
