LUBBOCK, TX — Court documents reveal more about the Texas Rangers' case against the Texas DPS Captain arrested in Lubbock last week for felony child sex charges.

DPS Capt. Gary Wayne McMillian, 54, is charged with two felony counts of indecency with a child by sexual contact.

According to the documents, McMillian is accused of two instances in 2008 and 2012 in Randall County. He is accused of touching te breasts of a girl who was under the age of 17 in 2008. Again with the same victim, he is accused of touching her genitals in 2012.

DPS said McMillian was arrested at his home by the Texas Rangers and held in the Lubbock County Detention Center. He has since been released awaiting a court hearing after posting a $50,000 bond. He was suspended with pay pending the outcome of this case.
