AUSTIN, TX — Texas Attorney General Ken Paxton is taking legal action to prevent the Biden administration from selling sections of the U.S.-Mexico border wall at heavily discounted prices. According to a press release from the Texas Attorney General's website, Paxton’s move comes after reports that the federal government may be auctioning off parts of the wall for as little as $5.
Reports suggest the Biden administration could be auctioning off up to half a mile of border wall per day. If true, Paxton argues that this could violate a federal court order requiring the government to use funds specifically allocated for border wall construction.
In May 2024, Paxton won a legal battle forcing the Biden administration to use funds intended for the border wall rather than redirecting them for other purposes. Now, Paxton is concerned that the sale of the wall sections could compromise that ruling. He argues that if the sections being sold were paid for with those designated funds, it would be a violation of the court’s order.
“The Biden administration cannot auction off sections of the border wall,” Paxton said. “If these reports are true, they are breaking a federal court order. Texas is going to court to stop this and find out what the government is doing with the wall materials.”
President-elect Donald Trump has also weighed in, calling for the outgoing administration to halt the sale. Trump has long supported building the border wall and has said that any attempts to dismantle it are damaging to border security.
“President Trump has an overwhelming mandate from the American people to build the wall,” Paxton added. “We will do everything we can to prevent the Biden administration from sabotaging border security efforts.”
Paxton has filed a motion with the court to intervene and prevent the sale of any sections of the border wall.
